Annual Gag Clause Attestation — Due December 31, 2025
Under the No Surprises Act and Transparency in Coverage rules, all group health plans and issuers are required to complete a Gag Clause Prohibition Compliance Attestation (GCPCA) by December 31 each year.
This federal requirement confirms your plan’s contracts do not restrict access to cost or quality-of-care information. To make this simple, HealthEZ has created a detailed guide and resource center to help you complete the attestation confidently.
Note: HealthEZ cannot complete the attestation on your behalf but provides resources and guidance to assist your submission.
What Is the Gag Clause Attestation?
The GCPCA requirement was established by the Departments of Health and Human Services, Labor, and Treasury. It ensures that no group health plan enters into a contract that prevents sharing or receiving important cost or quality-of-care data.
Each year, plans must confirm compliance by submitting an attestation through the Centers for Medicare & Medicaid Services (CMS) portal.
How to Complete Your Attestation
Step 1: Visit the CMS submission portal.

Step 2: Log in or request an access code.
Click “Don’t have a code or forgot yours?” to request a new login code (valid 15 days).
Step 3: Complete your submission.
Follow the prompts in the CMS web form to enter submitter and attester information, plan details, and attest your compliance.
Step 4: Save your confirmation.
Keep a copy of your receipt or submission confirmation for your records.
